The purpose of this information is to provide you with a clear and detailed explanation of how, when and why we collect and use your data. It has been designed to introduce to you in a simple and transparent way our policy on the protection of personal data and illustrate how to effectively exercise your rights.
This information refers only to the data processed by Nutraceutica through this Website and does not concern other websites, platforms or social network pages that may be reached via links on the Website: in these cases, it is always necessary to refer to the information available on the respective pages.

  1. Who is the controller of my data?

    Since Nutraceutica S.r.l. Unipersonale, PI 02226151203, determines the means and purposes of the processing of personal data involved in the use of this Website, it is the Data Controller.

    NUTRACEUTICA will collect the information you directly provide:

    • when you access and navigate the site;
    • when you send questions or suggestions through the sections or contacts dedicated to this;
    • when you register on the Site;
    • if you sign up for the newsletter service.

     

  3. What data will you process?

    When you browse or use the services on the Nutraceutica website, the following types of data may be processed:
     

    Browsing data 

    Some personal data whose transmission is implicit in the navigation of websites, including but not limited to data traffic and regarding the location, the weblog and other communication data for possible billing purposes or regarding the resources you access through the device, are acquired by the computer systems that allow their correct functioning. Even if this information is not collected to be associated with identified data subject, it could allow users to be identified - by their very nature and through processing and association with data held by third parties. For example, these include the IP addresses or domain names of the computers used by users who connect to the Site, the unique addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server and other parameters relating to the operating system and browser used.

    • Purpose of processing: to allow you to use the Website safely and correctly;
    • Legal basis for processing: legitimate interest of Nutraceutica in the correct functioning of the Website and to the security of navigation, regularly balanced with the rights of the data subject (art. 6, paragraph 1, letter f, GDPR).
       

    Request information through the dedicated sections

    You can contact us via the contact form or by using the contact details indicated on the site to request information or assistance, also regarding individual products available on the Site; this involves the subsequent acquisition of the data you have communicated to us (name, surname, e-mail address and the information contained in the communication) and, obviously, means that you allow us to send you any response communications using the contact details you provided us at the time of the request. 

    • Purpose of the processing: to ensure adequate support in relation to your needs and to respond to your requests.
    • Legal basis for processing: the provision of the service you have requested (art. 6, paragraph 1, letter b, GDPR).
       

    Registration and access to your personal account

    You can create a personal account by filling out the form on the dedicated page on the Site.
    For registration and access to the reserved area, the user's personal data and/or those that identify him/her (name and surname) are collected. You can also optionally provide us with any other data requested. Once you have submitted a registration request, Nutraceutica will send you the access credentials for your personal account to the email address you provided during registration. The password can always be freely changed by the user by accessing their reserved area, complying with the security features set by the Controller (for example, number and type of characters that can be used). Access to the reserved area will allow you to view the products and download the guides, catalogs and technical sheets made available on the Site and relating to the products themselves. By expressing explicit consent, you can also consent to receiving advertising material. This and other content downloaded from the site represents material owned by the Controller.
    Once you have created your personal account, your page will store information relating to your identification and contact details. You will always be able to manage your personal information and history, directly from your account or by making a specific request. You will also have the option at any time to delete your account and all the data stored therein: in this case, some data will still have to be stored by Nutraceutica for the periods of time required by applicable law.
    After deleting your account, the Data Controller will only retain the data relating to the registration of your requests, registration and cancellation, necessary to demonstrate correct fulfillment by the Data Controller.

    • Purpose of processing: to use the features and services reserved for holders of a personal account.
    • Legal basis for processing: to execute the contractual relationship to which the data subject is a party (art. 6, paragraph 1, letter b GDPR ).
       

    Sending communications in the context of soft-spam

    In some cases, we may use the email address communicated by the user using the site (for example, in the case of a personal account or in the case of requests for specific products) to send some promotional communications, even without requesting the user's prior consent. This process will be carried out in compliance with the provisions of art. 6, letter f), GDPR and art. 130, paragraph 4, of Legislative Decree 130/2003. In particular, users are informed of the processing activity through this information and are always recognized the right to object, in a simple and freeway, to such processing: each communication sent by the Data Controller, in fact, contains the reference to this information and the instructions on how to request the interruption of the processing (via opt -out), by contacting the Data Controller or directly selecting the appropriate link made available at the bottom of each communication.

    • Purpose of processing: to inform you about products similar to those you previously purchased and of possible interest to you;
    • Legal basis for processing: the regulatory provision pursuant to art. 130, paragraph 4, Legislative Decree 196/2003 which legitimises the sending of communications regarding products or services similar to those already requested (art. 6, paragraph 1, letters c and f, GDPR).
       

    Newsletter and marketing communications

    Nutraceutica sends newsletters, commercial, promotional and advertising information via email relating to the products and services offered, special events or promotion of dedicated offers.
    Nutraceutica newsletter is sent via email to those who explicitly request it, by filling out the appropriate form on the Site with their email address and authorizing Nutraceutica to process their personal data for the aforementioned purpose. The service is provided exclusively upon explicit and unequivocal expression of consent by the user (issued by selecting the appropriate box on the Site) and the provision of data is mandatory only for the purposes of receiving the newsletter and any refusal will result in the impossibility of using the service, without further consequences.
    The newsletter service is provided through the Mailchimp platform , of The Rocket Science Group LLC, which operates under the parent company Intuit Inc.: for further information, we invite you to read the Privacy policy available here: https://www.intuit.com/privacy/statement and here: https://mailchimp.com/it/about/privacy-rights . The designated EU representative, pursuant to art. 27 of the GDPR, is the company Intuit France SAS, 7 Rue De La Paix, 75002, Paris 2, France, TVA FR66802640292, to whose DPO the data subjects can contact to exercise their rights and to obtain more information on the processing of their data: dpo@intuit.com . Since Mailchimp is based in the USA, if you decide to activate the newsletter service you should know that your data may be transferred outside of Europe to carry out this processing. Mailchimp applies various measures to ensure that such data transfers are carried out safely and in compliance with European privacy regulations and in particular both Intuit and The Rocket Science Group are registered with the Data Privacy Framework ( https://www.dataprivacyframework.gov/list ) to guarantee the adoption of adequate security measures.
    In any case, to stop receiving the newsletter, simply select the cancellation link at the end of each email or send a specific request to the email address info@nutraceutica.it. Cancellation is managed in a partially automated way, so further newsletters may arrive for a period subsequent to such request, in any case no later than 72 hours from the cancellation request, and whose sending had been planned before receiving the cancellation request.

    • Purpose of processing: to send the data subject communications via email regarding NUTRACEUTICA products and services, news and updates on related topics, as well as offers and promotions reserved for those registered with the service, to carry out market research in order to improve the experience and quality of the services offered;
    • Legal basis for processing: the consent of the data subject (art. 6, paragraph 1, letter a, GDPR) freely given and revocable at any time, by sending communication to the Data Controller at the addresses indicated on the Site or by selecting the unsubscribed link at the bottom of each communication.
       

    Cookie

    What are they? The term cookie refers to a small text file that stores brief information about your navigation on a particular website, which will be installed on your device when you log in. Each cookie contains various data (e.g., the name of the server it comes from, a numeric identifier, etc.), can remain in the system for the duration of a session (until the browser is closed) or for long periods and can contain a unique identification code.
    When you visit the site again, they will be forwarded to the site that generated them (first-party cookies) or to those provided by third parties capable of recognizing them (third-party cookies).

    Analytical cookies (which may NOT require your consent if anonymized)
    These cookies track the choices made on the site and data relating to users' online navigation (for example, pages viewed, time spent on a page, etc.), in order to perform statistical analyses, usually in anonymous and aggregate form. If users are traceable and identifiable through these analyses, these tools can be used only with the prior expression of their consent.
    However, when the following circumstances apply:

    • the IP address has been duly anonymized;
    • the information obtained with analytical cookies refers to a single IT resource (site, app, etc.) and is used only in an anonymous and aggregate form;

    • Legal basis for processing: depending on the case
      • the legitimate interest of Nutraceutica to optimize the performance of the Site and improve the services provided through the Site, regularly balanced with the rights of the data subject (art. 6, paragraph 1, letter f, GDPR);
      • the user's consent (art. 6, paragraph 1, letter a, GDPR), freely given and revocable at any time, via the cookies banner or by following the instructions below and in the Cookie Policy

    Profiling and marketing cookies (which require your CONSENT): 
    This site also uses profiling and third-party cookies, the installation of which is subject to your prior consent given via the banner or also managed at any time through the Cookie Policy.
    Profiling cookies may include different categories, including advertising profiling cookies, retargeting cookies or social cookies.

    Social media plugins
    On NUTRACEUTICA there may be some buttons that redirect the user to the Controller’s profiles on social networks. Only after clicking on these buttons, some cookies for marketing and profiling purposes may be activated by the third parties that manage the social networks. NUTRACEUTICA does not directly manage these tools, but informs you of the possibility that, by using the App's functions, they may be activated.     Disabling via browser

    Finally, your personal data may also be used for the following purposes:

    • comply with legal obligations and requests from public or government authorities;
    • manage any disputes or litigation and therefore defend the rights of Nutraceutica both in and out of court.

    In such cases, the legal bases of the processing will be:

    • for point a), the fulfillment of a legal obligation;
    • for point b), the legitimate interest of the Data Controller in protecting its rights, provided that they are adequately balanced, from time to time, with the rights of the data subject.
       

  5. Who will you share my data with?

    In compliance with the purposes indicated in the previous section, Nutraceutica staff may be responsible for processing your data in order to provide you with the services, information or support requested.
    Therefore, access to your personal data will be expressly authorized by the Data Controller, who, if necessary, may appoint the subjects to whom it turns for the provision of services and for the activities within its competence as Data Processors pursuant to articles 28 and 29 of the GDPR.
    We also remind you that the list of data controllers is available from the Data Controller, to whom you can request it using the contact details indicated above.
    User data will not be transferred to third parties under any circumstances except where the nature of the services provided requires it, or where, by virtue of a legal obligation or in the presence of a legitimate interest, the Data Controller needs to communicate them to the competent jurisdictional or control authorities

     

  6. How will you treat my data?

    Your personal data will also be processed with the aid of electronic means for the strictly necessary time to achieve the purposes envisaged with the collection.
    Nutraceutica will adopt the technical and organizational measures necessary to prevent the loss, illicit or incorrect use of data, as well as to prevent any form of unauthorized access by third parties.
    Therefore, Nutraceutica will guarantee the security of your personal data by limiting the number of subjects who will be allowed to access the servers or databases and by implementing protection systems aimed at preventing the risk of cyber-attacks.

     

  7. Are my data processed outside of Europe?

    The data processed by Nutraceutica resides on servers located in Europe.
    However, some providers of cookie services are based in countries outside Europe, particularly in the United States, as also specifically indicated in our Cookie Policy.
    In these cases, personal data may also be transferred to servers located in the United States: in these cases, compliance with the guaranteed measures provided for and required by the adequacy decision adopted by the European Commission on 10 July 2023 regarding personal data transferred from the EU to US companies and their adoption by the relevant supplier will always be verified. All necessary precautions will therefore be adopted in order to guarantee the best possible protection of personal data by basing such transfer: a) on adequacy decisions of the recipient third country expressed by the European Commission; b) on adequate guarantees expressed by the recipient third party pursuant to art. 46 of the Regulation; c) on the adoption of binding corporate rules, so-called Corporate binding rules and, in particular, by preparing technical and IT security measures that protect the personal data and the rights of the data subjects in the best possible way, as required by the GDPR and European legislation .

  8. How long will you keep my data?

    Nutraceutica will process your personal data for the time reasonably necessary to achieve only the purposes listed above, which can be consulted in the Section “What data will you process?” or for the retention periods established by the sector legislation. Furthermore:
    - the data used to send the newsletter will be stored until your request for cancellation;
    softspam communications will be retained until your request for cancellation or for two years from the last time you expressed interest in Nutraceutica services (for example, by contacting us via the Site);
    - for the deletion of data processed through cookies you can find the information in our Cookie Policy.
    At the end of the retention period, your personal data will be deleted or made irreversibly anonymous.

     

  9. Links to third party sites and social networks

    Nutraceutica may contain links to and from the websites of our partners, as well as to advertisers and social networks. Please remember that the Controller assumes no responsibility for the personal data that may be collected through these sites and the use of the related services and that, if the user follows a link to any of these websites, he or she is invited to consult the Privacy policies provided by each external entity with respect to NUTRACEUTICA.

     

  10. What are my rights and how can I protect my privacy?

    In relation to your personal data and in compliance with the provisions of the GDPR, Nutraceutica informs you that you have the right to request:

    • access to your data;
    • the modification and rectification of any errors in our databases relating to your data;
    • the deletion of your data if they are held in the absence of legal requirements;
    • the limitation of the processing of your data;
    • opposition to data processing;
    • data portability.

    Access

    You can ask to:

    • Request confirmation of any processing of your personal data;
    • Get a copy of your data;
    • Provide you with further information about your personal data that is not already present in this policy.
    Rectification

    You can request the rectification of inaccurate or incomplete personal data.
    Before proceeding with the rectification, we will verify the accuracy of the data in our archives.
    Cancellation/
    Right to be forgotten

    You can request the deletion of your personal data, but only if:

    • Their permanence is no longer necessary in relation to the purposes for which they were collected;
    • You have denied your consent previously provided (where the processing is based on consent);
    • The processing was carried out unlawfully;
    • It is necessary to comply with a legal obligation to which Nutraceutica is subject (in relation to an order from an Authority).
    Limitation

    You can ask to restrict your personal data, but only if:

    • Their accuracy has already been disputed;
    • They are no longer necessary for the purposes for which they were collected, but there is an ongoing legal challenge regarding their use.

    Following your request for restriction, the use of your personal data is however permitted when:

    • Your consent remains in any case;
    • It is necessary to exercise or resist legal action;
    • To protect the rights of another natural or legal person involved in the processing.
    Portability

    You can request a copy of your personal data in a structured, machine-readable and commonly used format.
    Opposition

    You may object at any time to the processing of your personal data when:

    • the basis of lawfulness of the processing is the legitimate interest of the Controller;
    • personal data are processed for direct marketing purposes including profiling to the extent that it is related to such direct marketing.

    When you object:

    • to processing for direct marketing purposes, the personal data will no longer be processed for such purposes;
    • in the case of legitimate interest of the Controller, the processing may continue only if he demonstrates the existence of compelling legitimate reasons to proceed with the processing that prevail over the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of a right in court.

    It is possible to exercise the right of opposition also with automated means that use specific techniques, such as those made available on the site in the personal page and in e-mails (unsubscribe link).

     

    Nutraceutica guarantees that any request regarding your rights will be responded to within thirty days of its receipt.

     

  11. Can I file a complaint?

    You have the right to lodge a complaint with the Data Protection Authority if you believe that the processing carried out by Nutraceutica does not comply with the provisions of European Regulation no. 679/2016 and national legislation.
    In Italy, the competent authority is the Data Protection Authority, whose contact details are available at the address http://www.garanteprivacy.it/ .
